Regulations for shipping order at SendGift.pl platform
Introductory provisions
- The SendGift.pl platform is available at sendgift.pl, is run by partners of a civil partnership under the name Dailyfruits S.C. Bartosz Krudysz Jacek Kwiecień with its headquarters in Warsaw, ul. Posag 7 Panien 1a, 02-495 Warszawa NIP: 679-307-70-34, REGON: 122432943. Data of the partners: Bartosz Krudysz (partner in a civil partnership), NIP 8141612560, REGON 180360730 and Jacek Kwiecień (partner in a civil partnership), NIP 6641943477 , REGON 121005297 or a natural person running a business under the name of DFSolutions Szymon Krudysz , entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister competent for economy, having Tax Identification Number NIP 52231196698, REGON 388047630.
Definitions
- Employee – a natural person (e.g. an employee, contractor, subcontractor, client or other person) selected by the Ordering Party who is receiving the Code from the Ordering Party.
- Seller - partners of a civil partnership under the name Dailyfruits S.C. Bartosz Krudysz Jacek Kwiecień with its headquarters in Warsaw, ul. Posag 7 Panien 1a, 02-495 Warszawa NIP: 679-307-70-34, REGON: 122432943 or a natural person running a business under the name of DFSolutions Szymon Krudysz , entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister competent for economy, having Tax Identification Number NIP 52231196698, REGON 388047630.
- Ordering Party – any entity which signed contract with the Seller or other entity which established business relations with the Seller for purchase and delivery of Sets with the use of Internet Platform: sendgift.pl.
- Platform – the Internet platform operated by the Seller at sendgift.pl which enables execution of shipping order by using a Code.
- Code – an individually generated coupon in the form of a sequence of characters with a specified delivery date for a dedicated Set made available to the Ordering Party, which enables the Employee to execute the Set shipping order using the Platform's infrastructure.
- Shipping order – the Employee’s declaration of will submitted via the Shipping Order Form and confirming shipping order for address and contact details provided by an Employee.
- Account - a Employee's account at the Platform, it contains data provided by the Employee and information about Shipping Orders placed by the Employee at the Platform.
- Registration form - a form available at the Platform that allows you to create an Account.
- Shipping order form – an interactive form available at Platform, enabling the placement of Shipping Order by adding a Set to the Cart and specifying the conditions of shipping order for address and contact details provided by an Employee.
- Basket - an element of the Platform's software where the Sets which are planned to be shipped and which were selected by Employee are visible.
- Set - a movable item / service available at the Platform which is the subject of the Sales Agreement between the Ordering Party and the Seller.
- Sales Agreement - sales contract for Gift Sets concluded between the Ordering Party and the Seller.
- Order Form – order or attachment to contract listing all details and essential information for proper execution of subject of the contract and confirming all arrangements between the Seller and the Ordering Party.
- Working days - these are days from Monday to Friday, excluding public holidays.

- The Ordering Party / Employee may communicate with the Seller using the addresses and telephone numbers provided in this paragraph.
- The Ordering Party / Employee may communicate by phone with the Seller between 8 am and 5 pm on business days.
Technical requirements
To use the Platform, including viewing the Platform's online assortment and placing orders for Products, it is required to have:
- an end device with access to the Internet and a web browser such as Internet Explorer version 11 or later, Firefox version 28.0 or later, Chrome version 32 or later, Opera version 12.17 or later, Safari version 1.1. or later
- an active e-mail account,
- enabled cookies and JavaScript.
General information
- The Seller, to the fullest extent permitted by law, is not responsible for any disruptions, including interruptions in the functioning of the Platform, caused by force majeure, unlawful actions of third parties or incompatibility of the Platform with the Ordering Party's or Employee’s technical infrastructure.
- Browsing the Platform’s assortment does not require creating an Account. Placing shipping orders by the Employees for Sets in the Platform's assortment is possible either after creating an Account in accordance with the provisions of §6 of these Regulations or by providing the necessary personal and address data enabling the Shipping Order to be completed without creating an Account.
- The products are a serving proposal. Due to the nature of the products sold, they may differ from those shown in the photos.
Creating an Account in the Platform
- To create an Account at the Platform, you must complete the Registration Form. It is necessary to provide an e-mail address, accept the Platform Regulations and set a login password.
- Creating an Account in the Platform is free.
- Logging in to the Account is done by entering the login and password set in the Registration Form.
- The Employee may at any time, without giving a reason and without incurring any fees, delete the Account by sending an appropriate request to the Seller, in particular via e-mail or in writing to the addresses provided in §3.
- By sending the account registration form, the Employee declares that the information contained therein is consistent with the facts, and also declares that this information does not infringe the rights of third parties.
Rules for placing a Shipping Order
- In order to place a Shipping Order it is necessary to:
- type in Code received by Employee and select the Set that is assigned to the Code and which is the subject of the Sales Agreement, and then add it to the virtual basket.
- Next to select ‘Place the shipping order’
- Being in basket type in the Code one more time and press ‘Use’ and later press ‘I place shipping order’.
- use the option of placing an Order without registration, register an account or log in.
- if the option of placing an Order without registration has been selected - fill in the Shipping Order Form by entering the details of the Order recipient and the address to which the Set is to be delivered, including in particular: a. Name and surname, b. Detailed delivery address, c. E-mail Address, d. Mobile phone number, select ‘Delivery options’.
- choose one of the available delivery methods (the way of shipping the Set) and click ‘I confirm the shipping order’.
- Incorrectly completed shipping order forms will not be considered by the Seller.
- The Seller reserves the right to refuse to execute shipping orders that raise doubts or contain incomplete data. The Employee will be immediately informed of such a situation.
Personal data at the Platform
- The administrator of personal data of Employees collected via the Platform is the Seller.
- Employees' personal data collected by the administrator via the Online Platform is collected in order to implement the Shipping Order and its’ proper settlement with the Ordering Party.
- The recipients of the personal data of the Employees of the Platform may be apart from the Administrator:
- selected carrier or intermediary performing the shipment at the request of the Administrator.
- Ordering Party, which handled the Code to the Employee.
- Employees’ data is stored only in the administration panel of the platform, access to which is secured with appropriate permissions.
- Employee has the right to access their data and correct them.
- Providing personal data is voluntary, but failure to provide the personal data indicated in the Regulations necessary to conclude a shipping order results in the inability to conclude the shipping order.
- The processing of the Employee's personal data takes place in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on hereinafter referred to as GDPR) and the Act of 10 May 2018 on the protection of personal data.
- Personal data is not shared with any external entities except those directly involved in the shipping order fulfillment process and / or settlement of the Sales Agreement as per §8.3.
Final Provisions
- Agreements concluded through the Platform are concluded in Polish.
- The Seller reserves the right to amend these Regulations. The changes may not infringe the rights of Employees resulting from Shipping Orders placed before the change was introduced. The amendment to the Regulations comes into force within 7 days from being published on the Website. The Service Provider will inform the Registered User or the User subscribed to the Newsletter about the amendment to the Regulations by means of an electronic message containing the text of the amended Regulations. If a Registered User or a User subscribed to the Newsletter does not accept the changes, they should notify the Administrator of this fact by sending a feedback saying "I do not accept changes to the Regulations", which will be equivalent to expressing a request to delete the Account on the Website and / or stop receiving the Newsletter.
- In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; Polish Act on Providing Services by Electronic Means; New Polish Act on Personal Data Protection.
