  1. The privacy policy defines the rules for the protection of personal data of Users using the Website.
  2. The administrator of personal data is Dailyfruits S.C. Bartosz Krudysz Jacek Kwiecień with its headquarters in Warsaw, Posag 7 Panien street 1a, 02-495 Warszawa (hereinafter referred to as the "Administrator" or "Seller" or "Service Provider").
  3. Personal data is processed in accordance with the New Polish Act on Personal Data Protection and the Act on Providing Services by Electronic Means.
  4. Providing personal data is voluntary, but necessary to use the full functionality of the Website, including the conclusion of a Sales Agreement.
  5. The administrator takes special care to protect the interests of the data subjects, and in particular ensures that the data collected by the administrator is processed in accordance with the law; collected for specified, lawful purposes and not subjected to further processing incompatible with these purposes; factually correct and adequate in relation to the purposes for which it is processed and stored in a form that allows the identification of persons to whom they relate, no longer than it is necessary to achieve the purpose of processing.
  6. The Customer agrees to the processing of the personal data provided by the Administrator in order to keep the account, keep the record of the Customer's purchase history and Customer's preferences.
  7. In the case of a Customer who uses the method of electronic payments on the Website, the Administrator provides the collected personal data of the Customer to the selected entity servicing the above payments on the Website.

  9. Cookie files (cookies) are small text information in the form of text files, sent by the server and stored on the side of the person visiting the Website (e.g. on the hard drive of a computer, laptop or on the smartphone's memory card - depending on which device is used by the visitor).

In order to exercise these rights, the User should contact the administrator in writing or by e-mail to the address indicated in the Regulations. In the event of a request to delete data, it is tantamount to deleting the Account.

2. The data protection officer has not been appointed at the side of Service Provider’s personal data administrator.

3. Your data will be processed for the purpose of:

3.1. performance of the order and the administrator's obligations under the sales contract - the legal basis for processing is the necessity of processing to perform the sales contract (Article 6 (1) (b) of the GDPR)

3.2. direct marketing of the administrator's products and services, including for analytical purposes and profiling - the legal basis for data processing is the necessity of processing to implement the legitimate interest of the administrator (Article 6 (1) (f) of the GDPR); the legitimate interest of the administrator is the possibility of presenting you with information about the administrator's services, presenting offers tailored to your needs and interests, and increasing the sales of administrator's services; an additional basis for direct marketing of the administrator's products and services is your consent (Article 6 (1) (a) of the GDPR)

3.3. the correct operation of the website sendgift.pl, in particular the prevention and detection of abuse, as well as the optimization of the use of the website to the extent that cookies can collect data about your activities in the network or IP address, data from cookies can be connect with data from orders, collecting aggregated statistics, maintaining the user's session of the shopping website (after logging in), thanks to which the user does not have to re-enter the login and password on each subpage of the website - the legal basis for data processing is your consent (Article 6 paragraph 1 (a) of the GDPR);

 

 

3.4. Establishing, investigating or defending against claims - the legal basis for data processing is the necessity of processing to implement the legitimate interest of the administrator (Article 6 (1) (f) of the GDPR); the legitimate interest of the administrator is protection against claims related to membership in the Program.

4.2. until you object to the extent to which your personal data is processed for the purpose of direct marketing of the administrator's products and services, including for analytical purposes and profiling

 

4.3. for a period not longer than the limitation periods in civil and criminal cases established in accordance with the applicable provisions of Polish law to the extent that your personal data will be processed for the purpose of establishing, investigating or defending against claims

 

4.4. in the field of session cookies for a period of up to 2 years or until they are deleted from the web browser, while in the field of permanent cookies, they remain in the browser until their expiry or until they are deleted by the user from the browser

 

4.5. You have the right to access your data and the right to request their rectification, removal or restriction of their processing.

 

To the extent that the basis for the processing of your personal data is the premise of the legitimate interest of the administrator, you have the right to object to the processing of your personal data. In particular, you have the right to object to the processing of data for the purposes of direct marketing and profiling. To the extent that the basis for the processing of your personal data is consent, you have the right to withdraw your consent. Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal. To the extent that your data is processed in order to conclude and perform the contract or processed on the basis of consent - you also have the right to transfer personal data, i.e. to receive your personal data from the administrator, in a structured, commonly the machine-readable format being used. You can send this data to another data administrator. You also have the right to lodge a complaint with the supervisory body dealing with the protection of personal data.
